In fulfilment of the provisions of article 10 of Law 34/2002 of July 11 on services provided in the information society and electronic trade, we hereby manifest that MUTUA UNIVERSAL MUGENAT, Mutua Colaboradora con la Seguridad Social Núm 10 (hereafter, MUTUA), whose CIF number is G08242463, has its corporate and tax address located at Av. MUTUA is registered with number ten in the Registry of Collaborating Bodies of Social Security of the Ministry of Employment and Social Security.

General Terms

Use of the website implies the express end full acceptance of the conditions exposed hereafter, without prejudice to those particular terms that may be applied to any of the specific services offered through the website. MUTUA reserves the right to modify these conditions of use at any time, as well as any other particular conditions.

Industrial and Intellectual Property Rights

MUTUA is the owner to all the industrial and intellectual property rights on the materials published on the web pages of all of its domains. Said rights protect graphic design elements, images, source codes, content and other items. All of this, with the exception of those rights that are not owned by MUTUA and that are the property of their respective owners.

Beyond the mere activity of downloading and saving onto the hard drive of the person (hereafter the user/s) accessing the information contained on the web pages of the domains of MUTUA, which is considered to be authorised, it is strictly forbidden to modify, distribute, reuse or resend all or a part of the content of the web pages in the domains owned by MUTUA for public or commercial purposes without the express written authorisation of MUTUA.

Those updates that infract the abovementioned dispositions may imply a violation of the intellectual and industrial property rights protected in the reformulated Text of the Law on Intellectual Property (TRLPI), resulting in the offenses outlined in articles 270 and ff. and concordant articles in currently applicable criminal law.

Documents contained in the Web Pages

The documents and graphics attached to the same located on the web pages of the domains owned by MUTUA may be modified at any time, without any need for prior warning by MUTUA.

MUTUA does not guarantee the adequacy of the contents of these documents and attached graphics, and is therefore not bound to respond when said inadequacy takes place, in cases such as typographical errors, nor is it responsible for the use of these documents by the receiving user, who will assume full risks for the consequences that may arise from their use. MUTUA will not be held responsible for the information and damages that may arise from said use.

Links to Third-Party Websites

MUTUA provides the user with access to other third-party websites via links with the exclusive goal of informing users of the presence of other sources of information on the internet with which they may expand on the information provided by the web pages of the domains owned by MUTUA. These links to third-party sites will not be construed as a suggestion or recommendation to visit the destination websites, which are beyond the control of MUTUA, and MUTUA therefore will not be held responsible for the contents of linked websites or for the results obtained by users through said hypertext links. Furthermore, MUTUA will not be responsible for those links located in linked websites to which it provides access.

Privacy and Protection of Information of a Personal Nature

The information of a personal nature provided by physical persons through the web pages of the domains owned by MUTUA will be incorporated in an automatic file owned by MUTUA for which it will be held responsible, being duly registered in the Registry of the Spanish Agency for the Protection of Information.

At the time of the collection of the information (for instance, the contact section, web access request, employment application, etc.) the user will be duly informed of the agreement to the stipulations of article 5 of Organic Law 15/1999 of December 13 on the Protection of Information of a Personal Nature (hereafter, LOPD). To the effects of the dispositions of the LOPD, MUTUA undertakes to fulfil its obligations to maintain the secrecy of provided information. Likewise, it will adopt the necessary measures to avoid its unauthorised alteration, treatment or access in accordance with the current state of technology.

Under no circumstances will the information be ceded to third parties for goals other than those foreseen for each case. MUTUA informs the users that it may use, in full anonymity, certain information from their visits to the web pages of its domains to analyze and study traffic to said pages and/or to improve the services provided.

Any data or information sent to MUTUA, regardless of its format and media, will be treated with full confidentiality and reservation. Only in the event that the State Security Forces and Corps require access to the information, under the strict terms of currently applicable legislation, and all legally established circumstances, will the information be disclosed in compliance with the Law. MUTUA will not use any information provided to it, or a partial or total reproduction of the same by any means for its own benefit or for the benefit of third parties.

With a general nature, users are informed that, if they wish to exert their rights to access, rectify, cancel and oppose the collected information of a personal nature, they may do so in writing, enclosing a photocopy of their National Identification Document (DNI) to MUTUA, (department of Computer Security), Avda. Restricted Access Areas in the Web Pages

Some web pages of the domains owned by MUTUA have restricted access areas for registered users only. The conditions of use, responsibilities and other aspects derived from the use of these areas are communicated to users at the time of their registration.

Limitation of Liability

In no event will MUTUA, its providers or third parties reflected on the web pages of the domains be held accountable for damages of any kind (including, among others, damages caused by loss of profits, loss of information or interruption of business) resulting from the use, impossibility to use or the results of use of the web pages of the domains, any web page connected thereto, or to the materials or information contained in any of said pages, either if said responsibility is based on a warranty, contract, fault or negligence or any other legal theory, and regardless of whether the plaintiff was warned or not of said damages. If use of the materials or information of the webpages of the domains implies the need to provide a service, repair or correct a computer or information, said user will be liable for the costs implied.

Applicable Law and Jurisdiction

In order to resolve all controversies or questions related to the present web site or to the activities developed therein, Spanish legislation will be applied, to which all parties expressly submit, the Courts and Tribunals of the city of Barcelona being competent for the resolution of all conflicts derived from or related to their use.
